This legal instrument (hereinafter, the “Terms”) constitutes a legally binding contract between you (hereinafter, the “User” or “Client”) and Innova Educational Services (hereinafter, “the Company”), a trade name (DBA) duly registered and operated by Sigma Nova Investments LLC, a limited liability company organized under the laws of the State of Florida.

Accessing, browsing, and using the website https://innovaevaluations.org/, as well as its transactional portal InnovaCentral (https://services.innovaevaluations.org/login) (collectively, the “Platform”), confers the status of User and implies the express, full, and unreserved acceptance of all the clauses stipulated herein. If the User does not agree with these Terms, they must refrain from using the Platform and its services.

Clause I: Ownership, Registrations, and Intellectual Property

1.1. Commercial Registration

Innova Educational Services is a trade name (Fictitious Name / DBA) operated by Sigma Nova Investments LLC, duly registered with the Florida Department of State Division of Corporations (Sunbiz) under registration number G26000040709 (Document Number M24000014120).

1.2. Registered Trademark

Innova Educational Services is a registered trademark of Sigma Nova Investments LLC, registered with the United States Patent and Trademark Office (USPTO) under Registration No. 7,479,882, dated August 20, 2025, in Class 35. The trademark covers services related to résumé preparation and writing, professional credential verification, and verification of educational and professional qualifications on behalf of third parties.

1.3. Copyright and Intellectual Property

All information contained on the Platform, including templates, legal texts, articles, isotypes, logos, and graphics, constitute the exclusive intellectual property of Sigma Nova Investments LLC. Their reproduction, copying, distribution, or transformation without the prior express written authorization of the Company is strictly prohibited.

Clause II: Legal Capacity and Conditions of Access

2.1. Legal Capacity

Use of the Platform is restricted to natural persons who have reached the age of majority (18 years old) and have full legal capacity to be bound under these Terms.

2.2. Client Portal and Credentials (InnovaCentral)

The provision of services requires the User’s prior registration on the InnovaCentral portal. Access credentials (username and password) are personal, non-transferable, and confidential. The User assumes exclusive responsibility for safeguarding said credentials. The Company reserves the right to unilaterally suspend or terminate any account that shows signs of illicit activity, documentary fraud, or violation of these Terms.

Clause III: Professional and Operational Disclaimer

To establish the exact nature of our business operations and delimit our legal liability, we expressly and formally declare the following:

3.1. Nature of Services

Innova Educational Services is an educational consulting firm that collaborates with credential evaluation companies and agencies affiliated with NACES or AICE. Innova Educational Services does not claim membership in NACES or AICE. The legality and validity of credential evaluation reports are issued and granted exclusively by evaluation agencies or consulting firms officially affiliated with NACES or AICE.

3.2. Exclusion of Legal and Immigration Services

Innova Educational Services is not a law firm, does not provide legal advice, and does not act as immigration attorneys, paralegals, or immigration document preparers. Our services are exclusively focused on academic, professional, and documentation support within the educational and professional context of the United States.

3.3. Disclaimer of Warranties

The Platform and its features are made available to the User on an “as-is” and “as-available” basis.

Clause IV: Third-Party Links and Exemption of Liability

The Platform may incorporate hyperlinks directing to third-party portals. Such links are provided for informational purposes only. Sigma Nova Investments LLC exercises no supervision over these external portals and therefore assumes no liability arising from the content, privacy policies, or potential damages resulting from interaction with such sites.

Clause V: License to Use User-Generated Content

In the event that the User posts reviews, testimonials, or ratings on associated platforms (e.g., Google Reviews, BBB), they grant Sigma Nova Investments LLC an irrevocable, perpetual, non-exclusive, and royalty-free license to use and reproduce said content for commercial and advertising purposes. The Company reserves the right to exercise moderation over any content that is defamatory or violates the law.

Clause VI: Limitation of Liability

To the maximum extent permitted by the jurisdiction of the State of Florida, Sigma Nova Investments LLC, as well as its officers or employees, shall not be liable for consequential damages, loss of profits, or punitive damages arising from the use of the Platform or decisions by third parties (institutions, employers, authorities) based on the managed reports. The maximum liability enforceable against the Company shall be strictly limited to the economic amount actually paid by the User to the Company for the specific service originating the dispute.

Clause VII: Jurisdiction, Applicable Law, and Dispute Resolution

7.1. Substantive Law

The validity, interpretation, and execution of this contract shall be governed by and construed in accordance with the applicable laws of the State of Florida, United States of America.

7.2. Binding Arbitration Clause

Any litigation or dispute arising from these Terms shall be submitted to and resolved exclusively through confidential Binding Arbitration. The arbitration proceedings shall be seated in Miami-Dade County, Florida, and shall be conducted in accordance with prevailing commercial arbitration rules.

7.3. Class Action Waiver

The User expressly and irrevocably waives their right to bring disputes before an ordinary court, to a jury trial, and to serve as a plaintiff or class member in any class action against the Company.

Clause VIII: Contractual Modifications

The Company reserves the right to update this document at any time. Modifications will take full legal effect from the moment of their publication on the Platform.
